TERMS OF SERVICE

This is an agreement between you and ZANDER PUBLISHING COMPANY (collectively, “Our Company”). Our Company provides online store website development service, online store mobile application service (collectively, “Services”). The Services offered by Our Company include various services to help you sell goods and services to buyers online. Please read these Terms of Service and the other policies available at Our Company’s website before using Our Company's services. By using the Services, you agree to be bound by the terms of this Terms of Service. You must read them carefully, agree with and accept all of the terms and conditions contained in these Terms of Service including the Privacy Policy. Our Company reserves the right to make changes to our policies and this Terms of Service at any time. Your continued use of the Services after the effective date of the revised Terms of Service constitutes your acceptance of the terms. 

1. USE OF THE SERVICES AND RESTRICTIONS

In the use of Our Company's Service, you must not violate any laws in your jurisdiction, your customer’s jurisdiction or the laws of the Hong Kong Special Administrative Region including but not limited to copyright laws. You must not use Our Company's Services for any illegal purpose or infringe third party’s rights in the use of the Service.

2. SUBMISSION OF CONTENTS

2.1 you warrant and represent that the content that you upload or provide does not contain any illegal, violent, obscene, pornographic, immoral, defamatory, discriminatory, false or threatening information.

2.2 you warrant and represent that you own the copyright and other intellectual property right of the content that you upload or provide.

2.3 you agree that you shall be solely responsible and liable for the content that you upload or provide.

3. SUSPENSIONS AND TERMINATION

3.1 For the non free Services provided by Our Company, you agree to pay the Service fees in advance before using that part of the Services. Our Company reserves the right to terminate your right to use of that part of Services without notice to you if you have failed to pay the Service fees. Your right to use of the Services will also be terminated if you do not accept the Terms of Service, have abused the use of the Services, have not complied with any terms of this Terms of Service, or in any circumstance that Our Company thinks suitable.

3.2 Your rights under this Terms of Service and the use of the Services will automatically be terminated without notice if you fail to comply with any of its terms. If your use of the Services is terminated or restricted, you will not receive any refund or any other compensation for any loss due to the termination or restriction and Our Company shall have no responsibility.

3.3 We reserves the right to revise the Service Fees.

4. NO REVERSE ENGINEERING

4.1 Whether in whole or in part, you must not decompile, reverse engineer, tamper with, copy, sell, upload, reproduce, distribute or bypass any security associated with Our Company's software, including but not limited to any code, software or application.

4.2 All software used in any Services is the property of Our Company and is protected by Hong Kong and international copyright laws.

4.3 We may offer updates automatically to Our Company's software at any time and without notice to you.

4.4 you agree not to disclose the login password to any third party, Our Company shall not have any legal liability due to any misuse of the login password.

5. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

5.1 You agree that Our Company does not warrant nor represent that:
5.1.1 the Services will be correct, error-free, complete, reliable or timely;
5.1.2 the software provided by the Services will be free from defects or bugs;
5.1.3 the software provided by the Services will be compatible with all hardware equipment;
5.1.4 the Services will be available for use in a place outside Hong Kong;
5.1.5 the Services will meet your expectations or requirements of including but not limited to the function, quality or safety of the services.

5.2 You agree that Our Company shall not be responsible or liable for:
5.2.1 any direct or indirect loss or damage in connection with any errors, delay, defects or bugs, unavailability, interruption, reliability of the use of the Services;
5.2.2 any litigation or claims arising out of the contents provided or uploaded by you;
5.2.3 any direct or indirect loss or damage caused to the relevant device in connection with your use or installation to the software provided by the Services;
5.2.4 any inability to use or to access the Services due to failure, delay or location restriction.

5.3 you agree that the total liability of Our Company arising from the Services shall not exceed the total amount of the Services Fees you paid, to the fullest extent permissible by applicable law.

6. OTHERS

6.1 Hong Kong court has the exclusive jurisdiction to resolve the disputes of the Terms of Service which shall be construed in accordance with the laws of Hong Kong.

6.2 The English version shall prevail if there is any inconsistency between the English version and the Chinese version of this Privacy Statement.
